The legality of dismissal and the extension of leave due to sick leave: what other questions did Dubrovno residents address to the legal inspector of trade unions
After the summer break, the practice of holding free legal receptions organized by the Federation of Trade Unions of Belarus resumed. On September 26, more than a hundred legal labor inspectors of the FTU went to the regions to advise everyone on the protection of labor rights and socio-economic interests. On that day, the chief legal labor inspector of the Vitebsk regional organization of the Belarusian Trade Union of Culture, Information, Sports and Tourism Workers Sergei Mandrik worked in Dubrovno.
Sergey Alexandrovich held a reception of citizens in the district House of Culture and met with the labor collective. Assistant District Prosecutor Tatyana Ryzhenkova also took part in the legal reception.
At the end of the meeting, those present were able to ask questions of interest to them and receive competent answers to them.
"Trade union legal receptions provide an opportunity for members of our organizations to receive qualified legal support on a wide range of issues," said Irina Sokolova, chairman of the district association of trade unions. "Trade union lawyers help to understand labor legislation, advise on how various documents are drawn up, and give recommendations on the correct resolution of emerging labor disputes.
By the way, the practice of holding trade union legal receptions was introduced in March 2015, and since November 2017, employees of the prosecutor's office have joined the trade union lawyers, which made it possible to more quickly solve the problems of citizens applying for an appointment.
An employee of the organization turned to the chief legal labor inspector, who was interested in the question of what advantages a father of many children has when reducing staff. Sergey Mandrik gave a detailed response to the appeal, and the assistant prosecutor of the district Tatyana Ryzhenkova stressed that this provision is in the collective agreement.
One of the employees asked a question: "During my vacation, I was on a temporary disability certificate to care for my sick grandson. Do I have the right to extend my leave?" Labor leave is extended only due to the illness of the employee himself (Part 1 of Article 171 of the Labor Code)."
As part of the Day of Legal Education, a meeting with the labor collective was also held on this day, during which Serhiy Mandryk spoke about the judicial practice of reinstatement at work, gave examples in which cases the court recognizes dismissal as illegal. The assistant prosecutor of the district drew attention to the need to comply with all legal requirements when dismissing employees.
